  • Sponsorship agreements and corporate gifting arrangements

SmashPoint reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

 

2. Product Information and Availability

2.1 Product Descriptions

SmashPoint strives to provide accurate product descriptions, images, and pricing information. However, we do not warrant that:

·       Product descriptions, images, or specifications are completely accurate or error-free

·       Photos accurately represent colors or sizes due to variations in lighting and display settings

·       All product information is always up-to-date or reflects the latest manufacturer specifications

We reserve the right to correct any errors in product descriptions, pricing, or availability without liability.

2.2 Product Availability

All products are offered subject to availability. While we make efforts to maintain stock, we cannot guarantee that items will remain available at the time of your order. In the event that a product is unavailable:

·       We may offer you an alternative product of similar value

·       You may choose to cancel your order for a full refund

·       We will not charge you until availability is confirmed

When you place an order through SmashPoint:

1.     You are making an offer to purchase the products at the advertised price

2.     We will send you a confirmation email or message acknowledging receipt of your order

3.     Receipt of confirmation does NOT constitute acceptance of your order

4.     Your order is only accepted when we send you an order confirmation indicating the goods are ready for shipment or pick-up

We reserve the right to refuse or cancel any order at our sole discretion

3.2 Order Confirmation

Once your order is confirmed, we will provide:

·       Order number and itemized product list

·       Total price including all applicable taxes and fees

·       Estimated delivery or pick-up date

·       Tracking information (if applicable)

3.3 Pricing and Taxes

·       All prices are displayed in Hong Kong Dollars (HKD) or USD as indicated

·       Prices are subject to change without notice, but changes will not affect orders already confirmed

·       All applicable Goods and Services Tax (if required), delivery fees, and other charges will be clearly stated before checkout

·       Promotional discounts and coupons are valid only as stated and non-transferable

·       Bulk discounts may apply for large orders; contact us for a custom quote

SmashPoint accepts the following payment methods:

4. Shipping and Delivery

4.1 Shipping Methods

SmashPoint offers multiple shipping options:

·       Standard Delivery: 3-5 business days (HKD 50-100)

·       Express Delivery: 1-2 business days (HKD 150-250)

·       Overnight Delivery: Next business day (HKD 200-350)

·       In-Store Pick-up: Free (at 212HK facility)

·       Local Courier: DHL, FedEx, SF Express, or other carriers (customer selected)

Delivery options vary based on product type and delivery location.

4.2 Delivery Address

·       You must provide a complete, accurate delivery address

·       We are not responsible for delivery failures due to incomplete or incorrect address information

·       For overseas deliveries, you are responsible for any customs duties or import taxes

·       We recommend providing a delivery address where someone can receive the package

4.3 Shipping Costs

·       Shipping costs are calculated at checkout based on order weight, destination, and selected delivery method

·       Shipping costs are non-refundable unless the product is damaged or defective

·       Free shipping may apply to orders over a certain value (see promotional details)

·       International shipping is available but may have additional fees

4.4 Delivery Timeline

·       Estimated delivery dates are provided at checkout but are not guaranteed

·       Delivery timelines do not include weekends or public holidays in Hong Kong

·       SmashPoint is not liable for delays or failures to deliver by estimated dates

·       We will make reasonable efforts to deliver orders on schedule

4.5 Risk of Loss and Title

·       Risk of loss transfers to you upon delivery to the delivery address or when you take possession at our facility

·       Title (ownership) of products transfers to you once full payment has been received and processed

·       You are responsible for the products once they are in your possession

4.6 Damaged or Lost Shipments

If your shipment arrives damaged or is lost in transit:

·       Report the issue within 7 days of delivery

·       Provide photos or video evidence of damage

·       We will file a claim with the shipping carrier on your behalf

·       We will replace the product or issue a full refund (including original shipping costs)

·       Shipping costs for the replacement are covered by SmashPoint

 

5. Refunds and Returns

5.1 Refund Policy Reference

·       14-Day Money-Back Guarantee: Full refund for unused, unopened products within 14 days of purchase

·       Manufacturing Defect Guarantee: 18-month replacement or refund guarantee for defective products

·       Final Sale Items: Clearance and discounted merchandise may be non-refundable

5.2 Return Shipping

·       For defective products, SmashPoint covers return shipping costs

·       For non-defective returns within the 14-day period (unused condition), customers typically cover return shipping unless SmashPoint caused the issue

·       Customers must use tracked courier services and include return authorization numbers

5.3 Refund Timeline

·       Once we receive and inspect your return, refunds are processed within 5-7 business days

·       Refunds are issued to your original payment method

·       Processing times may vary depending on your bank or payment provider

 

6. User Responsibilities and Prohibited Activities

6.1 Your Responsibilities

By using SmashPoint services, you agree to:

·       Be responsible for all activities that occur under your account

·       Notify us immediately of any unauthorized account access or security breaches

You may NOT:

8. Limitation of Liability and Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS AND OUR REFUND POLICY, SMASHPOINT MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING PRODUCTS OR SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SmashPoint does not warrant that:

·       Products will meet your specific needs or expectations

·       Products will be available indefinitely

·       Website functionality will be uninterrupted or error-free

·       All defects will be corrected

·       Use of products will not cause injury or damage

8.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SMASHPOINT SHALL NOT BE LIABLE FOR:

·       Indirect, incidental, special, or consequential damages

·       Loss of profits, revenue, data, or business opportunities

·       Loss of use or enjoyment of products

·       Personal injury or property damage

·       Damage from product defects, design flaws, or manufacturing errors

·       Damage from normal wear and tear, misuse, or customer negligence

·       Damage from delayed or failed deliveries

·       Website errors, outages, or technical failures

·       Unauthorized access to or alteration of your personal information

MAXIMUM LIABILITY: In any case, SmashPoint's total liability shall not exceed the total amount paid by you for the products or services in question.

In the event of a dispute:

·       We will respond within 5-7 business days

·       Provide documentation supporting your claim

Step 2 – Management Escalation:

·       If not resolved, request escalation to our management team

Step 3 – Alternative Dispute Resolution:

·       If the dispute persists, either party may request mediation

·       Mediation will be conducted by a neutral third party

13. Termination of Service

Grounds for immediate termination include:

No oral agreements or representations are valid unless confirmed in writing by SmashPoint management.
